Wednesday in front of the ninth Circuit Court in Portland Oregon

Joe Walsh from IFJ [Individuals for Justice] reports back on 3.7.12


Today was Wednesday, we were there to witness one of our leaders take his place on the 9th Circuit Court of Appeals, a man who will decide cases ranging from an inmate’s right to legal representation in our prison system to a whole range of other issues. 

 One day he may have to decide whether a person will get his freedom or stay in prison.  Maybe there is a contract issue that one party does not like the conclusion of a lower court and is appealing; kind of important stuff if you are paying the cost of appealing a decision that you just know is wrong.  This is what the 9th does day in day out, they make decisions that affect the very foundation of our judicial system.  This may be the last place one goes for Justice and in my opinion, the most important court because if you lose at this level, after some attempts to have the Appellate Court think again about the case, you can only go to the Supreme Court and they only take very important cases, about 100 per year.  So, what does it mean when you get a defective judge, a judge that has in the past sold his soul for a seat on the court;  it means a lot. 

Most people walking by our small group do not know who this monster is, never heard of Judge J. bybee.  That is why we stand in the rain and cold, to tell them a story that is very hard to believe.  Our biggest problem is getting people to believe the saga of this man who came close to destroying our Department of Justice and turning it into a Department of Torture.  This man who said it is ok to beat children, to drive people insane, to make prisoners think they are going to die,  allow a president to think he and only he has the power to allow the CIA to make families believe their children will be beaten to death unless we get the correct answers.  All who played a part in this indefensible reign of terror must be brought to Justice, not for some political concept but because we must get our souls back as a nation. 

We will annoy the court for two more days, Judge j. bybee will leave Portland on Friday and our protest will end, others will protest in their own way when he arrives in San Francisco, Nevada or maybe Seattle.  We are dedicated to bringing all the war criminals to some level of Justice and sitting on the Court of Appeals is not one of our options, sitting in prison is definitely on the top of the list.

Judge j. bybee came to Portland and we were there to meet him.

We, of noble intentions were there, we stood for an hour starting about 0800 and left after court started.  Malcolm flew his VFP flag with the stars and stripes and we told our story of the “Bug” Judge to be repeated during the time he is in Portland, March 5-9.  You all know of the water boarding, the way he got his name by saying it is ok and legal for the President to order torture but you must not call it torture. 

 

This once great country can hurt and kill without punishment because we are so powerful.  All countries that have sought empire have been invincible for a short time, but justice is always close as the British found out.  The Germans were among the strongest of nations until people said enough.  America tried judges, lawyers, and politicians for war crimes after WW2 and someday bybee, yoo, cheney, bush and the rest will look over their shoulder and see a prosecutor with guts and they too will stand before the bar of justice and their fate will be sealed. 

 

We will be there tomorrow at 1130-1:00 PM, stop by for a bit to join byee for lunch. 

 

We did not see him today, he is hiding from us---fits with his personality of cowardice.  We will decided each day what time we will take up our watch the next, I will try to get word out to you each day.  This person of shame who calls himself j. bybee, we call “The Monster of the Desert.”  Come join us or just stop to say hello.  Many people stopped by to ask about this torture judge and when we told them who he is they could not believe that he is out and about, free, sitting on one of the best courts, but someday history will be written and he will read it in a dark place of shame.

This is the person who signed off on the torture memos and gave the cheney/bush administration the legal basis for torturing prisoners in our custody. He was given a seat on the 9th Circuit Court of Appeals, as a reward. He is a disgrace to the legal profession. Individuals For Justice will protest him coming to Portland to sit in judgment of others when he should stand trial for war crimes. His nickname is the "Bug Judge."

He got the nickname the "Bug Judge" from his position that it is OK to put a prisoner in a closed box and put live bugs in with him/her during questioning. He thinks it is legal to bang the prisoners heads against the wall. Torture by humiliation, you must have seen the naked prisoners piled high and our soldiers laughing at them--just fine with this monster. Just go google bybee-torture and learn what a real monster looks like.

We will protest his arrival at the 9th Circuit Court this coming in front of the old courthouse, 700 SW 6th Ave (across from Pioneer Square.) Will you join us in telling this War Criminal to get out of our city. He is scheduled to be here all week

Judge **j. bybee of the Court of Appeals for the Ninth Circuit is coming to Portland, Oregon.



Judge ** bybee will be here to hear cases at the Pioneer Court House during the week of March 5th and ending Friday March 9th. This person, in my opinion, is a mass murderer and should be told to his face he is like a skunk, nice to look at but causes one to vomit. This is **bush's judge who wrote or approved the justification for the torture of prisoners in foreign lands including Iraq and other Middle East countries. He is a scoundrel of the first order, a man who belongs in prison, not sitting on one of my favorite courts. We must welcome him to our city with a protest to let him know this veteran and you despises everything he stands for, and does not want him here to smell up our city. Will you join us in front of the 9th Circuit to welcome him on Monday March 5 at 0800 and every day he is in Portland? Many, many soldiers were killed because of what he and professor **yoo justified in the treatment of prisoners who were in our custody. Have you heard of Abu Ghrib--he is the man that said it was ok to beat, torture prisoners with water-boarding, hanging them up with chains, putting humans in closed boxes and inserting bugs, mocking them with nudity, etc. He was appointed to the 9th Circuit as a reward from **bush for justifying the terrible treatment of Iraqi prisoners and anyone else.

immigration cases despite charges of incompetency
You may recall the judgeʼs nickname - this is the same legal
counselor who authorized placement of a prisoner in a closed
box with live insects as one of some dozen interrogation
methods employed by the Bush administration at CIA prison
camps that amounted to torture. But chilling as contents of his
2002 memos were, Bugsʼ role in crafting the U.S. torture
program has been largely ignored:
Bybee is generally the forgotten man in torture studies of the
Bush era. The best known of the legal architects of the torture
regime is John Yoo, who was a deputy to Bybee. For better or
worse, Yoo has been a vocal defender of the various torture
policies, and he remains outspoken on these issues. But
whatever happened to his boss? Today, Bybee is a judge of the
United States Court of Appeals for the Ninth Circuit. He was
confirmed by the Senate on March 13, 2003--some time before
any of the "torture memos" became public. He has never
answered questions about them, has never had to defend his
conduct, has never endured anywhere near the amount of
public scrutiny (and abuse) as Yoo. It is an understatement to
say that he has kept a low profile since becoming a judge. Itʼs a
lesson in the vagaries of politics, and timing, that Bybee could
slip through the cracks of this story so easily. - Jeffrey Toobin,
New Yorker magazine
Last year the New York Times called on Congress to impeach
Jay Bybee over his role in authorizing the "torture memos",
writing "these memos make it clear that Mr. Bybee is unfit for a
job that requires legal judgment and a respect for the
Constitution."
Jay Bybee, the former head of the Office of Legal Counsel,
justified and authorized clear acts of torture by the CIA during
the Bush Era. Bybee was confirmed as a federal judge to the
Ninth Circuit Court of Appeals in March 2003, well before his
now infamous torture memos came to light. A lifetime
appointment, he sits in a deciding position on the bench when
there is clear evidence that his judgment is tainted.
More recently, judge Bybeeʼs contributions to the legal
framework underpinning Arizonaʼs draconian immigration bill SB
1070 have come to light. Considering the disrepute those
interpretations have occasioned with Bybeeʼs legal peers, one
has to wonder why the hell he has not recused himself from the
cases he presides on in the courthouse in front of you today.
In a document, written in 2002 by the Justice Department's
Office of Legal Counsel, Bybee concluded that state police
officers have "inherent power" to arrest undocumented
immigrants for violating federal law. The author of the Arizona
law has cited this authority granted in the 2002 memo as a basis
for the legislation. While the bill has been condemned by
President Obama and received intense opposition from civil
rights groups, Bybeeʼs memo complicates challenge of the
hated Arizona immigration law.
ACLU's Cecillia Wang calls for the Obama Justice Department
to withdraw the 2002 memo, which she finds legally incorrect,
saying "The fact that this memo is lurking out there gives cover
and comfort to people in Arizona and other states who want to
pass these overbroad and extraordinary anti-immigration
measures." What really has to happen is to have the author of
these cruel and illegal opinions removed from the bench.

AFTER FAILED MEETING AT THE RED AND BLACK CAFE


Out and about with my friend and fellow trouble maker/activist Roberto to bring Justice to where we live.  Going backwards Sunday, we were at the call to action around the country to stop the war with Iran before it goes hot.  We joined members of OP, Veterans for Peace, members of Oregon Progressive Party, Individuals for Justice and many more groups and individuals to yell, "No War with Iran!" 

There were many good people gathered at Shemanski Park to march around Portland to let the world know we do not want war with Iran or anyone else.  I got to carry the VFP flag for a time and that always makes me smile.  Friends and fellow activists were in and around the park, we were there because all the signs by obama are now saying we are preparing to bomb Iran and maybe Syria. 

I cannot imagine another war or maybe two, if there is a God she must be weeping for us, because we are too stupid to learn to live in Justice and Peace.  The music was good, some of the speeches were good, I was dancing and pleased that so many came out with a last minute call to action on a Sunday afternoon; I was happy. 

I was talking to someone and one of the speakers mentioned the peace monitors.  I dislike people who go around telling other people to stay on the sidewalk, or not so loud. or don't yell "F..k the cops" or whatever reasons they are there.  I don't want to argue the point.  Just saying...

Roberto and I had come from another meeting at the Red and Black Cafe that was billed as an interview with two candidates here in our wonderful city.  Mary Nolan, (candidate for commissioner) and Eileen Brady (running for mayor).  We went mostly to listen to Brady as I have heard what Nolan had to say a few weeks ago. 

I was taken back by the place for this interview, the Red and Black is one of my favorite places, they make good mochas there and Roberto and I often go there after a protest.  They advertise themselves as a place of:
About the Red & Black Café:
"We are a worker-owned, collectively–managed, IWW-member vegan café. We are open from 9 am until 10:30 pm, and host performances and events in the evening. We were located on SE Division Street from October 2000 – September 2007, and after a 3 1/2 month hiatus, we reopened at 400 SE 12th in January 2008." From their website.

The interviews started with Nolan, so I was talking to people and noticed people were starting to gather around where the interview was happening, cutting off half of the café.  The manger did not look happy. 

Roberto came over to tell me that the manger said that the café had not been informed of the interviews and was not happy that Ms. Brady was in their place of business.  I thought, Oh Shit.  I got a chance to ask Brady if her store was union, did the employees belong to a union, she said no--I asked why?  Her answer was cut off by a member of the Green Party who asked me if I was a representative of the Oregon Progressive Party as they were a sponsor of this event, I went ballistic!

First of all, The café was not notified that we were going to even have an interview, never mind have cameras in the place.  Second,  to have Brady in the place is almost as bad as a cop in uniform come in and order a cup of coffee. 

Brady is anti-union and the store New Seasons, just fired a ten year employee for defending the right of other employees to express an opinion.  One of the regular customers at Red and Black asked about him and this ex-CEO/founder of New Markets said she has nothing to do with the stores now and may look into the matter but has given up any policy making ability.

My reaction to all of this:
1.
  Whoever was the representative of the Green Party and Oregon Progressive Party should call the Red and Black Café and apologize for not requesting their approval “BEFORE” the interviews, cameras, and event happen.

2.  OPP do not join in anything that the Green Party is involved with until they also apologize to the Red and Black Cafe.  Roberto and I want to return and not hide our heads in shame.  Fix this mess very soon!

I asked Roberto to write something up about what he saw so that this report is not just this old activist’s opinion, here is what he sent me, without  editing:

"Joe,  Yesterday we attended a Q & A with Portland Mayor and Council candidates. Unfortunately, this was not a well organized or thoughtful event (the Green Party). This caused some friction with the Co-op employee-owners of the cafe because no one checked in with them to arrange the use of the cafe for this event. Some us there apologized to the Red & Black Cafe owners for this inappropriate behavior. Hopefully, they will forgive us for abusing their space with political stuff.
   

Anyway, we asked candidate Mary Nolan about her opinion on JTTF and she gave a standard politician answer. We asked her about about the Portland City Charter Review commission and she said that she would support it every four years, but not every two years which actually would be better for the citizens of Portland. I spoke with her that as a council member the people would be knocking on her door for redress of the current status quo. I told her that the US Congress is no longer responsive to the citizens of America and that the battle for change will be on the local level. She responded with the answer that we should elect new Congress people. The US Congress is bought & owned by the corporations. What redress there?

I spoke with Eileen Brady candidate for Mayor of Portland. She said if elected that she would support and fund the Portland City Charter Review Process. And I spoke with her about the topic of sustainability. I said that without justice there is no sustainability and this drew a blank stare from her and she walked away because she was in a hurry to get some where else. My point to her was that sustainability is a generic white elitest term that moves gentrifying development for the upper-middle class and the 1%. I was born in Santa Barbara, California, 65 years ago. The Environmental movement started there (remember the first major coastal oil well spill was there), the solar movement started there and community Gardens were started there in the early 1970's. Sustainability jargon has gentrified Santa Barbara so that the original inhabitants can no longer afford to live there, where's the justice in that? The elitist 1% now owns Santa Barbara, California and Portland , Oregon is following in those same steps. What happens is that in these high-end sustainability development zones the poor and people of color get moved out because of the value of the land to the 1% and developers. Thus, I say, Without Justice there is No Sustainability! We need to change the status quo in these movements and to shake up the whole mess.

Individuals For Justice, supported by The Oregon Progressive Party will return to the Hawthorne Bridge on the West-side near 1st and Madison this Friday at 1530, (3:30 PM).

This is a protest to remind people going home for the weekend that we continue our war in Iraq with mercenaries, still murdering civilians in Afghanistan, Yemen, Libya, Somali, and any country we think will hurt us or Israel.  We are, along with NATO, dropping uranium laced bombs and missiles on small countries and telling the world we are saving them from evil leaders. 

President Obama decided HE can murder women and children at will without any meaningful debate in the Congress of the United States; an impeachable offense. 

Come and join us and take a ride on the Justice side.

                        My sign this week will read:

SYRIA OR IRAN
EVER”


The warmongers are at it again, just listen to what they are telling us on the corporate news about Syria and Iran.  Are you going to believe that we must go to war to save the people of Syria from their government or are you going to say do everything possible to avert war.  We are not in eminent danger from either country!  We must start showing the people of the world we will only go to war with a country if they threaten us with real violence and will stop this preempted bullshit. 

It will rain so bring an umbrella and rain gear.  For those of you out of town, keep us in your hart.  This is a non-violent protest.

Going back in time, Roberto and I had some fun meeting good people and continued our protest on the Hawthorne Bridge each Friday. We will be there until we get worn out or the wars in the Middle East are over and done. Last Friday we flew our VVAW flag for the first time and our friend and fellow fighter for Justice, Joe-Anybody did take some video. We stand each Friday from 1530 until about 1700 on the west side at 1st and Madison to remind people that we continue to murder in Iraq, Afghanistan, Gaza, Yemen, Pakistan, Syria, and any nation we "Think" will hurt us or one of our friends. We have become the bully of the world and there is no end in sight.

We are now in the process of preparing for war with Syria, all the name calling is done, the only thing left is convincing you that Syria is a bad nation and must be invaded. We and Israel are also planning on bombing Iran, the same argument is being used against Iran as Iraq; weapons of mass destruction. Iran wants to have nuclear weapons and that will not be allowed by the US and Israel. Having nuclear weapons should be banned by all nations and the USA should start to destroy ours first because we have the most. Russia, China, Israel, Great Britain, India, Pakistan, and so on should follow suit.

Our foreign policy needs to look for justice and stop looking for new markets for our military goodies. So, we continue to tell people keep the pressure on for Justice and Peace will follow.

After coming off the HB, we attended a candidate's forum that was less than outstanding, in how it was put together. I think the sponsors were the Greens, Occupy and my party, the Oregon Progressives.

The candidates were ok, but the format was a combination of how Occupy runs their GA, and how the Portland Green Party runs its meetings. This way of doing things may work well at General Assemblies but for a political event it sucks. The moderator has way too much power and wastes too much time deciding if the question is a rebuttal, direct question or asking for more information. Just let the people ask a question and get an answer.

I love Occupy but this format does not work and should be modified to make it more simple. All of the candidates answered the questions with direct responses. I would be ok with any of them winning the election.

There was one funny moment when Jefferson Smith was answering a question and said something like, "And as your governor... ... " he is running for mayor. Jefferson is starting to change my mind about him becoming our mayor. I like many of his ideas.

Amanda Fritz was there and again the more I see her in the race the more I like her. She has always been my favorite on the counsel, but her vote for JTTF and Sit-Lie ordinance were deal breakers for me, I wanted her to stand with most of the groups who testified against both measures. I will watch this race and vote for the person who comes close to what I believe.

I got to see my friend and sister in the battle for Police accountability JoAnn, and that always makes me smile. She made her presence known by asking good questions and making announcements at the end of the meeting of upcoming events. The night was a success but I still think that the format was annoying.

There are many things to be done, if you sit on your ass and don't get involved with our city government you will feel helpless and that is not good for our city. I know we are all busy but do something each day and we may get a government that tries to do the right thing. You don't have to be right all the time, but you must try all of the time to be a good citizen and learn something each day. I am the little old guy with egg on his face from time to time; eggs are good.

There are lots of commissions and groups that try to help, join one. There is a sub-committee looking over the Charter now that could use some support, the group is lead by JoAnn A. Hardesty and is looking at police accountability. The next meeting is Wednesday at City Hall, about 6:00 PM in the Rose Room on the third floor.




The other meeting was with the CRC, Citizen Review Committee. This committee was established to listen to citizens concerned about our police force. This was a scheduled meeting that just happened to follow another deadly shooting by two of our cops.

The meeting was intense and included how the police were directed or not directed during the eviction of Occupy from the parks. I was impressed with the volunteers who sit on this committee and wish they had more power to resolve problems concerning the citizens of Portland and our police department.

The question of the shooting was brought up but little is known about the event and will take some time to answer the questions raised. This is a public meeting and more people should attend and let your feelings be heard by a group of good citizens, listen to your encounters with the police. This group needs more power to investigate any complaints but now it is a good idea to bring the actions to the Independent Police Review Division and follow what is being done.

Finding a lawyer to fight for you is important and should be done. One complaint may get lost, but many will put the offending police officer in the light of "Something must be done."

Joe, I think that most of the folks attending the CRC had fear of the police and negative experiences with the Portland police. Also, I asked the candidates at the forum, if elected would they support taking us out of JTTF? And there was not enough time to get an answer from them because of the wasted format time. Also, there was good audience testimony from those attending the CRC.

Roberto and I were out among the people who try to do some good for others, working for justice or just letting people know that the wars are still going on in the Middle East. Among the first politicians to feel the impact of the decision of the Supremes were the very people who cheered when the high court decided corporations were entitled to all the protections of the Bill of Rights. If you've been following what is happening with the primaries in the GOP you already know that Michele Bachmann is gone, only to be seen late at night flying on a broom and yelling, "Why do you not love me?" Rick Perry should be out of the race but it would seem that the people of Texas would rather he stay away for a time so he is still in the race to be embarrassed for a few more weeks. Jon Huntsman, the closest to a human being, is way back and should get out.

We were on the Hawthorne Bridge about 4:00 PM and enjoyed our outside shower. The rain and cold caused both of us to ask, what the hell were we doing, but we did get the sympathy vote. We did have a few people who were walking in the rain thank us for doing what we are doing. The bicyclists were with us and gave us the V sign or rang their bells in support. This was our second protest of the day.

About 11 in the morning we were at the Governor Hotel over on 11th Avenue to protest the exclusion of all candidates except the "democrat and the republicon" running for the open seat in the 1st District due to Rep. Wu's resignation. This event was particularly offensive to me because many of the people I kind of like were in the audience. When you go to these make believe debates, unless you are there to report on the BS, you encourage this kind of exclusion. I saw Steve Novick, and many other democrats; they lost my vote. I wanted to go in and disrupt the event but respected the person who called this protest, I was not the organizer, just there to support the call for action.

The other meeting we went to was a Labor Committee that is attempting to submit a people's budget to the City Council sometime in the future, trying to do more than just whine about lay-offs and reduction of benefits. This is a fun group and I like being around them. The other meeting I attended was the East Side Democratic Club, last Tuesday.

Jefferson Smith is running for mayor. I went into the meeting remembering our last get together when I was pissed at Smith for talking about a Public Option when the rally was about Single Payer Health Care. He remembered me and we talked some. His presentation or talk was very good. I did some research and he is an interesting guy, he may get my vote! I give him credit for showing up. The East Side Democratic Club was expelled from the democratic party for some reason like being independent or some terrible thing like calling for the end of wars, I like them, they do good stuff for others.

The warmongers are at it again with let's bomb Iran,
the latest craziness coming out of DC is that we are moving anti-missiles to Israel. This stuff never ends.

Roberto and I, along with others, want to have a City Council who will listen when their constituents speak. When they invite us to give our opinions but end up doing what they want, that is most frustrating.

Almost forgot, went to a council meeting, Mayor Sam Adams is working on a resolution to declare that corporations are not people and the Supreme Court ruling was terrible. This decision must be overturned or ignored by the States.

There are some good people running in the upcoming elections, please don't vote for the lesser of two evils, vote for someone who just might make things better.

When I was at the eviction of Occupy in Portland and the police horses were forced into the crowd, the first thought that went through me was the horses were going to hurt someone. The second thought was why the hell are the police using animals to hurt other humans. Now my thoughts are to take the horses away from the cops. Seems like a good project for us to take on.

Want to "take a ride on the Justice side?" This is something all of us can give some time to, maybe we can see these beautiful horse retired to a farm, enjoying life. I know we are all busy but I got really pissed at the cops for making these animals move into the crowd and risk being hurt, when all the horses wanted to do is eat some hay.

E-mail me and after some ground work, if enough of you feel bad for those horses as I did that night, let's work to... ..."Free the Police Horses."
